STUDIO TERMS & CONDITIONS

Terms & Conditions of Andy Whittaker Photography

In the following Terms and Conditions:

“Business” shall mean Andy Whittaker Photography.

“Client(s)” shall mean “You” as the main contact.

“Session” shall mean the photographic experience appointment.

“Order Appointment” shall mean the appointment where your select and place your order for any products.

“Photographer(s)” shall mean Andy Whittaker Photography.

“Studio” shall mean the business location where all photographic sessions take place.

“Session Fee” shall refer to payment for any of our Portrait Experiences.

“Booking Deposit” shall mean the holding deposit for all photographic experience appointments.

“Experiences” shall refer to the types of photographic session available for purchase. These experiences are acquired by purchasing a experience voucher from our website, or from time to time promotional stands.

Session Fee

All our sessions have a value that must be paid before any booking can be made. Each of our sessions have a different value and may or may not include products as part of that session. Once a session has been purchased and payment received, that session must then be booked within three months of purchase unless agreed with the business. If a session is not used within the three months of purchase, then any monies will be retained. If a session has not been booked and a refund for the session is requested within three months, then a refund will be given once any vouchers or voucher packs have been returned.

Booking Deposit

Upon booking your session, we will require a booking deposit to secure your appointment. Our booking deposit is £50, and payment must be made at the time of booking your appointment. Your booking deposit is refundable at your Order Appointment. Alternatively, you can use your booking deposit as credit towards any products purchased. Your booking deposit will be retained if you fail to attend any of your appointments or your appointment is cancelled without sufficient notice. The minimum notice period we require to cancel any appointment is seven days. If less than seven days’ notice is given, then the booking deposit will be retained to cover the cost of the cancelled appointment. If an appointment is cancelled at short notice and the booking deposit is retained, you can still book back into the diary, but a fresh booking deposit will be required. We run a small diary with no more than 6 appointments per week. This is why we require a booking deposit to secure your appointment and our time.

Portrait Experience Vouchers

We offer several portrait experiences, and they can be purchased through our website.

All experiences are slightly different and may or may not include a product as part of the experience.
All our experience vouchers must be used within 3 months of the purchase date.
Experiences cannot be refunded if a booking has already been arranged.
Experience vouchers cannot be used in conjunction with any other offer or voucher purchased.
Only 1 of each experience voucher can be used for the same subject/family within 12 months.
Experience vouchers may be purchased as gifts, but again only 1 per subject or family per 12 months.

Your Portrait Session

All our sessions are booked by appointment only and have a specific time slot. It is recommended that you arrive 10 minutes before your arranged appointment, especially if you are not familiar with the area or where the studio is located. This means we can give you the full amount of time you have booked with us. If you encounter a delay or know you are not going to make the appointment on time, then please call the studio straight away so that we can ascertain whether the appointment can still go ahead. We understand that sometimes things happen that are out of your control and we will try to accommodate as much as possible. However, if an appointment is going to be later than 15 minutes past the start time then we will recommend rescheduling for another date as it isn’t always possible to give you the experience we would like in a shorter amount of time.

The Photographer(s) shall be granted artistic license in relation to the poses photographed and the backgrounds used. Every effort will be made to comply with any of the Client(s)’ requirements in terms of how they would like the images to look, although on occasion down to the willingness of subjects it may not be possible to capture all the images requested. The Photographers’ judgement regarding, poses and the number of photographs taken shall be deemed correct.

Image Editing & Order Appointment

All effort is made to create a fantastic set of images that you will be proud to display in your home. When you come to view your portraits at your order appointment the portraits you see are 80% finished. This means that any blemishes and marks on the skin, dust, anomalous objects etc... are only removed on images purchased. We will only remove blemishes if this is something you have agreed to or requested, please do not assume it is done automatically. Please note that all images are viewed on a projection screen. This means that the colours and sharpness will slightly differ on your finished product. In the majority of cases the colours and subjects will look sharper on the final product.

As with the Portrait Experience please make sure to arrive on time so that we can give you the full experience.
All Order Appointments are conducted at the studio, we do not have an online option.
Payment for orders is taken on the day, so please remember to bring your preferred payment method with you.
Any products purchased after the agreed Order Appointment will be subject to our standard fee and not the discounted price on our price guide.
Any credit from offers is valid at your order appointment only. Credit cannot be saved for a future purchase.
All orders are subject to a 4 week turnaround time.
All our products are bespoke and therefore once your order is placed cannot be refunded.
If you decide to take any photographs out of the supplied frames, we take no responsibility for any damage that may be caused to the frame of the print.
Any reproduction of a product by yourself or a 3rd party is expressly prohibited as it infringes on our copyright of the photographs unless you have been provided with the digital copy as part of your purchase.

Collection

As part of our quality control, we check all orders for signs of damage or elements that were agreed and not actioned from the Order Appointment. We ask that all customers return to the studio to collect their orders. We like to present your portraits to you to make sure you are completely happy with the final product. We cannot be held responsible for any damage that occurs after the order has left the premises. Digital files are provided at full resolution meaning that you can print them to the maximum size. Digital products are provided on a Quantum Card that uses NFC technology rather than a USB. If you would prefer a digital download link this can be provided upon request

Re-Orders

All reorders are very welcome and shall be treated as an extension of the Contract. Orders should be provided in writing to avoid an error.

Copyright

Any images or copies of images whether stored digitally or otherwise are protected by the Copyright and Design Act 1988 and always remain the copyright of The Photographer(s) unless there is express written agreement to the contrary. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of Andy Whittaker Photography.

License of Use

Purchasing the Digital images with Andy Whittaker Photography does allow you license to print and share the purchased images. The Client(s) have permission to make copies of the images under the following conditions: The images taken by the photographer(s) are for personal use only by the Client(s) and their family and friends, at no additional cost. The Client(s) may publish photographs to social media if they wish. The photographer(s) also grant the client a print release on all photographs for personal use. There is no limit on how many times the photographs may be printed. It should be noted that although the Client(s) have license to use the images this in no way transfers copyright of the images to the client. Andy Whittaker Photography still hold copyright to all images.

Display

Andy Whittaker Photography may on occasion wish to use use images included from the session on their website, portfolio, literature, display areas, exhibitions, competitions, advertising, slide shows or commercially. Andy Whittaker Photography respects the privacy of every client. Under GDPR law, every client photographed by Andy Whittaker Photography will be asked for consent before displaying any client images.

Complaints

All complaints should be raised by the Client(s) directly to the Andy Whittaker Photography in writing within 14 days of the occurrence which gives rise to the complaint. Andy Whittaker Photography will consider the complaint and shall respond to the Client(s) within 14 days of receipt of the complaint.
